Overview

This consultation seeks views on the Scottish Government’s proposals for delivering Anne’s Law in primary legislation, to ensure that people who live in adult care homes have rights to see and spend time with the people who are important to them.

The development of Anne’s Law follows a Care Home Relatives Scotland Petition: PE1841.  This petition was lodged by Natasha Hamilton, who was unable to see her mother, Anne Duke, for prolonged periods during the height of the pandemic.  The petition called on the Scottish Parliament to urge the Scottish Government to allow a designated visitor into care homes to support loved ones.

Within the Fairer, Greener Scotland: Programme for Government 2021-22, which was launched on 7 September, a commitment was made to deliver Anne’s Law. It aims to strengthen residents’ rights in adult residential settings and give nominated relatives or friends the same access rights to care homes as staff while following stringent infection control procedures.

One of the main drivers for introducing Anne’s Law is a recognition that families and friends play an essential role in the health and wellbeing of people who live in these homes (in terms of both practical and emotional support).  Prolonged isolation from family and friends is likely to be detrimental to the welfare of the resident.

This consultation invites views on the potential aims of and proposals for legislative provisions to support Anne’s Law.

Why your views matter

It is important that we hear views and suggestions on the proposals to achieve Anne’s Law so that we do it in the best possible way.  We want to hear from as many people as possible to shape the proposals – including people who live in adult care homes, their families and friends and care home providers and staff.

A five week period has been proposed for the consultation and we are inviting responses by Monday 2 November.  This is to align with work on developing the National Care Service Bill (NCS), a possible mechanism for Anne’s Law, for which the consultation closes on 2 November.

Easy Read versions of the consultation paper and respondent information form and questions are available on the Scottish Government website.

A British Sign Language format of this consultation will be made available shortly.

Other accessible formats are available upon request. To request those, please email: ALconsultation@gov.scot

If you require a paper copy to be sent to you, please email us or call our automated phone service on 0300 244 6600 and leave a message.

Workshops for residents

We have developed two workshops specifically for care home and supported housing residents. The workshops will allow us to share proposals as well as hear the views of those who this will be most important to. Questions can be raised and feedback will be collated.

We would appreciate if care home and supported housing providers and staff could encourage and support residents to participate and provide any necessary help for them to access the session.

We would also encourage family and friends of residents to support them to attend, as well as participate in the workshop themselves.

We are aware that this topic may be emotionally challenging for residents and their families. Please note that some residents may need additional emotional support.  Support can also be accessed at Age UK and PAMIS.

These workshops will be on:

Monday 18th October 11:00-12:00pm click here

Monday 25th October 11:00-12:00pm click here

The workshops will have a BSL interpreter at both.

Those who would like to particulate should register their interest at the above link.
